4 Talk With a Foster City Family Law Attorney About Your Next Step

A family law dispute in Foster City can affect where your children live, whether you can remain in the family home, how monthly expenses are paid, and what your finances will look like after the case ends. A Foster City family lawyer can help you make decisions before temporary arrangements become long-term problems.

At Law Offices of Ali Yousefi, P.C., we represent California families in divorce, custody, support, property, and related matters with individual attention and a strategy built around the client’s actual priorities.

Ali Yousefi founded the firm with a focus on making a direct, positive difference for people facing stressful legal problems. Our approach is personal: we take the time to understand what matters most to you, explain your options, and prepare for the possibility that an issue may need to be decided in court.

What Is Family Law?

Family law covers the legal rights and obligations that arise from marriage, separation, parenting, financial support, and family safety. Many times, a single case may involve several of these issues at once.

For Foster City residents, these matters generally proceed through the San Mateo County Superior Court. The court’s family law departments are based at the Southern Branch:

400 County Center

Redwood City, CA 94063

Most cases follow a recognizable path even though the disputes differ. After a petition and response, the parties may need temporary orders for custody, support, or control of property while they exchange financial information and work toward a resolution.

Some issues settle through negotiation or mediation, while unresolved issues go to a hearing or trial. Knowing which decisions must be made now and which can wait often prevents a family from spending time and money fighting over the wrong issue first.

What Types of Foster City Family Law Topics Do We Handle?

The Law Offices of Ali Yousefi, P.C., handles a wide range of family law matters for individuals and families in Foster City. Depending on your circumstances, we can assist with the following issues.

Divorce

A divorce legally ends a marriage, but ending the marriage is only part of the process. Spouses may also need to decide how to divide property and debts, whether one spouse will pay support, and, when they have children, how custody, parenting time, and child support will work.

That means child custody/support, and property division in Foster City may all be handled in the same divorce case.

You and your spouse can reach an agreement on some or all of these issues and submit it to the court for approval. When you cannot agree, the judge can decide the unresolved issues.

California imposes a minimum six-month waiting period before a divorce can become final. The six months run from the date the responding spouse is served with the summons and divorce petition or appears in the case, whichever occurs first.

Custody

Child custody determines how parents will share responsibility for their child after separation or divorce. It covers both who makes important decisions for the child and where the child will live.

The two main types of custody:

  • Legal custody: The right to make important decisions about the child’s education, healthcare, and general welfare.
  • Physical custody: Where the child lives and how parenting time is divided between the parents.

Parents can share legal or physical custody, or one parent may have primary responsibility in either area. When parents cannot agree, the court decides custody and parenting time based on the child’s best interests.

In San Mateo County, parents with disputed custody or parenting-time issues are generally required to participate in custody-recommending counseling through Family Court Services before the judge decides the dispute. First-time participants must also complete the court’s Parent Orientation Class before counseling.

Child Support

Both parents have a legal duty to support their children. When parents separate, California generally uses a statewide guideline formula to determine how much child support one parent should pay to the other. The goal is to divide the financial responsibility for the child between the parents based on their circumstances.

The guideline calculation considers factors such as:

  • Each parent’s income,
  • Parenting time,
  • Tax information, and
  • Other relevant financial factors.

Because income and parenting arrangements can change, an existing child support order may also be modified when circumstances materially change. For Foster City parents, accurately documenting current income and the actual parenting schedule can be especially important when seeking to establish or modify support from the San Mateo County Superior Court.

Spousal Support

Spousal support is money one spouse may be required to pay the other during or after a divorce. California courts may award temporary support while the case is pending and longer-term support as part of the final judgment.

For longer-term support, the court considers factors such as:

  • Length of the marriage,
  • Each spouse’s earning capacity,
  • Marital standard of living,
  • The supporting spouse’s ability to pay, and
  • Parties’ assets and debts.

These factors help the court determine whether support is appropriate and, if so, the amount and duration.

Property Division

California generally treats property and debts acquired during marriage as community property, while property owned before marriage or received individually as a gift or inheritance is usually separate property. Unless the spouses agree otherwise, the court generally divides the community estate equally.

The harder question is often determining which category an asset belongs in. Tracing those contributions and obtaining accurate valuations can be important before agreeing to a final property division.

Prenuptial Agreements

A prenuptial agreement allows a couple to decide before marriage how certain financial issues will be handled if they later separate or divorce. It can address property rights, asset management, and what happens to property at divorce, but it cannot limit a child’s right to support.

California also has specific requirements that can affect whether a prenup is enforceable, including the requirement of voluntariness. The Law Offices of Ali Yousefi, P.C. can help draft or review a prenuptial agreement, identify terms that may create problems later, and make sure the process complies with California law before you sign.

Modifications and Enforcement of Court Orders

Family court orders may need to change as a family’s circumstances change. A parent may seek to modify custody or parenting time after a significant change affecting the child, while child or spousal support may be adjusted when income, parenting time, or other relevant circumstances change.

Enforcement is different. When a spouse or parent fails to comply with an existing order involving support, custody, property, or another obligation, the court can take steps to enforce compliance.

The Law Offices of Ali Yousefi, P.C. can help you request a modification when an order no longer fits your circumstances or pursue enforcement when the other party is not following it.

Restraining Orders

A restraining order can limit contact, require someone to stay away, and address issues such as possession of the home, custody, or parenting time. Because these orders can affect both safety and ongoing family court proceedings, the way the facts and supporting evidence are presented matters.

The Law Offices of Ali Yousefi, P.C. can help you prepare or respond to a restraining order request, organize evidence, prepare for the hearing, and address related custody or visitation issues.
